A human fatality always requires testing. Otherwise, testing is required when the driver receives a citation for a moving traffic violation and the accident involved either bodily injury with immediate medical treatment away from the scene, or disabling damage requiring a vehicle to be towed. A citation alone, or an injury alone without the citation, does not trigger the federal requirement.
Course Overview
After certain truck and bus accidents, federal law requires the employer to have the driver tested for alcohol and drugs on strict deadlines. Compliance is usually decided in the first hour, by people working under pressure. This course trains the people who manage that response: which accidents require a test and which do not, the deadlines, who does what, how the tests happen under 49 CFR Part 40, and the documentation that protects the company when a test cannot be completed.
The decision matrix comes straight from the rule: a human fatality always requires testing; a citation for a moving traffic violation requires testing when it is paired with either bodily injury treated away from the scene or disabling damage requiring a tow. The course drills the three clocks (2 hours to document, 8 hours for alcohol, 32 hours for drugs), the no-alcohol rule after an accident, the driver availability duty, results and the Clearinghouse, and closes with rapid-fire scenario drills plus a program checklist. No federal regulation requires this course itself, and the course never claims the training is mandatory. The duties taught inside it are federal requirements under 49 CFR 382.303, and 49 CFR 382.303(f) separately requires every employer to give its drivers the necessary post-accident procedures and instructions before they operate.
